Agreeing to these terms

These Terms & Conditions (the “Terms”) form an agreement between you and Funding Invest Grow (“Funding Invest Grow,” “we,” “us” or “our”). They govern your use of fundinvestgrow.com, our request form, and any calls, texts or emails connected to them (the “Services”). By using the Services or submitting a request, you accept these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

The Services are for business owners and their authorized representatives who are at least 18 years old and able to enter a binding agreement. If you act for a business, you confirm that you have authority to do so.

What we do, and what we do not

• We gather information about your business and goals and introduce you to independent funding partners who may be able to help.
• We are not a lender. We do not make credit decisions, issue funding, service accounts or collect payments.
• We do not promise that you will receive an offer, or any particular product, rate, amount or term. Funding partners make those decisions.
• Submitting a request is free of charge.

Your request and your responsibilities

When you use the Services, you agree that:

1. the information you give us is accurate, complete and kept up to date;
2. you are authorized to submit it and to allow us to share it with funding partners and service providers as described in our Privacy Policy;
3. you will not provide false, misleading or stolen information; and
4. you will keep any account details or confirmation messages we send you confidential.

Offers and third-party terms

Any offer of funding comes from the funding partner, not from us. The partner’s own agreement, disclosures, pricing and privacy notice apply to that offer, including any commercial financing disclosures required in your state. Please read them carefully before you accept anything. We are not a party to your agreement with a funding partner and are not responsible for its decisions or conduct.

Calls, text messages and email

By submitting our form and agreeing to be contacted, you consent to receive calls, text messages and emails from us at the details you provided, including messages sent with automated technology. Consent is not a condition of getting help from us, and you can withdraw it at any time.

Acceptable use

You agree not to:

• use the Services for anything unlawful, fraudulent or misleading, or to pose as another person or business;
• interfere with or disrupt the Services, or attempt to gain unauthorized access to them or to related systems;
• use bots, scrapers or other automated tools to collect content or information from the Services, except as the law allows;
• introduce viruses or other harmful code; or
• copy, resell or exploit the Services or their content for any purpose we have not approved.

Intellectual property

The Services, including the Funding Invest Grow name, logo, design, text and graphics, belong to us or our licensors and are protected by intellectual property laws. We give you a limited, non-exclusive, revocable permission to view and use the Services for your own lawful business purposes. All other rights are reserved.

Third-party websites and services

The Services may link to, or embed tools from, websites and providers we do not control, including the provider of our request form. We are not responsible for their content, availability or practices, and your use of them is subject to their own terms.

Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted or error-free, or that any funding will be available to you.

The information on our website is general and educational. It is not legal, tax, accounting or financial advice, and you should consult a qualified professional about your own situation.

Limitation of liability

To the fullest extent permitted by law, Funding Invest Grow and its owners, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or business opportunities, arising from your use of the Services or from any funding decision or conduct of a third party. Our total liability for any claim connected to the Services is limited to the greatest extent the law allows. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to defend and indemnify Funding Invest Grow and its owners, officers, employees and agents against claims, losses and expenses, including reasonable legal fees, arising from information you submit, your breach of these Terms, or your violation of any law or the rights of another.

Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Before starting a formal claim, please contact us and give us a reasonable chance to resolve the issue informally. If we cannot, the state and federal courts located in North Carolina will have exclusive jurisdiction, and you and we consent to that venue. Nothing in these Terms limits any right you have under law that cannot be waived.

Changes, suspension and termination

We may update these Terms from time to time by changing the “Last updated” date on this page. Your continued use of the Services after a change means you accept the updated Terms. We may suspend or end access to the Services at any time, including if we believe you have breached these Terms.

General provisions

• Entire agreement: these Terms and the Privacy Policy are our complete agreement about the Services.
• Severability: if any part is found unenforceable, the rest stays in effect.
• No waiver: failing to enforce a provision is not a waiver of it.
• Assignment: you may not transfer these Terms without our written consent; we may transfer them as part of a business change.
• Electronic communications: you agree we may give you notices electronically, and that electronic records satisfy any requirement that they be in writing.
